Terms and Conditions of Service

This Terms and Conditions Agreement (hereinafter, the "Terms") governs the contractual relationship between inetHost (hereinafter, "the Company") and the user (hereinafter, "the Client") regarding the acquisition and use of infrastructure services, hosting, and technological solutions (Web Hosting, Housing, Bare Metal, Cloud Servers, among others).

By contracting our services, the Client acknowledges having read, understood, and accepted all the provisions established herein, in accordance with the current legislation in the Argentine Republic.

1. Declarations and Legal Capacity

1.1. Acceptance of the Contract

The subscription to any inetHost service implies full and unreserved acceptance of these Terms, as well as our Privacy Policies and Payment Policies. In case of discrepancy, the particular conditions of a specific product shall prevail over the general ones.

1.2. Capacity to Contract

The Client declares to possess the necessary legal capacity to bind themselves contractually according to the laws of their place of residence. In the Argentine Republic, this implies being over 18 years of age or being legally emancipated. If the contracting is done on behalf of a legal entity, the signer guarantees having sufficient powers to bind the entity.

1.3. Accuracy of Information

All information provided by the Client during registration shall have the nature of an affidavit. The Client is obliged to keep their contact and billing information permanently updated.

2. Account Management and Security

2.1. Activation and Credentials

After validation of the request and corresponding payment, the Company will provide the access credentials. The Client is solely responsible for the custody and confidentiality of their usernames and passwords.

2.2. Responsibility for Operations

Any activity carried out under the Client's account shall be considered authorized by them. The Client must immediately notify the Company of any suspicion of unauthorized use or security breach.

3. Service Conditions

3.1. General Scope

inetHost provides technical infrastructure for data storage and processing. The Company reserves the right to manage hardware and network resources to guarantee the stability of the ecosystem for all users.

3.2. Resource Consumption

The Client agrees not to make excessive use of resources (CPU, RAM, bandwidth) that degrades the service of third parties. In shared or Cloud services, the Company reserves the right to limit or suspend processes that exceed reasonable use parameters.

4. Acceptable Use Policy (AUP)

The Client is obliged to use the services exclusively for lawful purposes. The following are strictly prohibited:

  1. Illegal Content: Storage or distribution of material that infringes copyright, intellectual property, or data protection laws.
  2. Security: Attempts to breach the security of own or third-party systems (hacking, phishing, etc.).
  3. Telecommunications: Use of BGP protocols, VPN, or tunnel services in services with mitigation included, unless expressly authorized.
  4. Network and Mitigation Use: Hosting game servers or high-impact applications on infrastructures that do not have specific DDoS protection (services without mitigation) is prohibited. Detection of traffic or processes associated with these purposes will result in immediate termination of the service without the right to a refund.

4.1. Anti-Spam Policies

Sending unsolicited bulk email (SPAM) is strictly prohibited. Abusive use is considered sending more than 100 emails per hour or 1,000 emails daily per account.

5. Availability and Warranty (SLA)

5.1. Uptime Commitment

inetHost guarantees a monthly Uptime of 99% under normal conditions. This average excludes scheduled maintenance tasks and failures derived from third parties (upstream connectivity providers, electric power, etc.).

5.2. Limitation of Liability

The Company will not be responsible for interruptions derived from Dos/DDoS attacks, fortuitous events, force majeure, acts of cyberterrorism, or failures in the Client's local equipment.

5.3. Backup

Data integrity is the sole responsibility of the Client. The Company recommends periodic external backups. VPS and Cloud services do not include automated backups unless specifically contracted.

6. Commercial Conditions and Billing

6.1. Payment Cycle

The Client will pay the corresponding charges in advance. Failure to pay on the due date will empower the Company to automatically suspend the service.

6.2. Refund Policy

The Client has a period of 48 hours from activation to request the revocation of the service and full refund, subject to the following conditions:

  • MercadoPago: 100% refund of the amount.
  • Bank Transfer: A 10% deduction will be applied for administrative and tax expenses.

There will be no refund if the termination is a consequence of a violation of the Acceptable Use Policy (AUP).

7. Modifications and Jurisdiction

7.1. Terms Update

The Company may modify these Terms at any time by posting them on the official website. Continued use of the services after such publication constitutes acceptance of the new conditions.

7.2. Applicable Law

For all legal purposes, this contract is governed by the laws of the Argentine Republic. Any controversy will be submitted to the jurisdiction of the ordinary courts of the Autonomous City of Buenos Aires (CABA).
